NEW REGULATIONS OF IMMIGRATION, RESIDENCE LAW FOR FOREIGNERS IN VIETNAM AND THE LABOR CODE FROM JULY 2020

1. What is the change?

– Amendments to the Law on Entry, Exit, Transit and Residence of foreigners will come into effect on 1 July 2020.

Furthermore, a new labor code will come into effect on 1 January 2021, replacing the Labor Code implemented in 2013.

2. Immigration Law Amendments.

There will be some changes to the visa types as below:

  • The LS visa: issued to foreign lawyers practicing in Vietnam.
  • The investor visa (DT) and Temporary Residence Card (DT type) will be divided into 4 types depending on the investment amount of the company in Vietnam.
  • DT1: issued to foreign investors and the representatives of foreign organizations investing in Vietnam with a capital contribution of VND 100 billion or more or invest in sectors and trades eligible for investment incentives and geographical areas investment incentives are decided by the Government.
  • DT2: issued to foreign investors and the representatives of foreign organizations investing in Vietnam with a capital contribution of VND 50 billion to 100 billion or invested in industries and branches encouraged to invest in development are decided by the Government.
  • DT3: issued to foreign investors in Vietnam and the representatives of foreign organizations in Vietnam with a capital contribution of VND 3 billion to VND 50 billion.
  • DT4: issued to foreign investors in Vietnam and the representatives of foreign organizations in Vietnam with a capital contribution of under 3 billion VND.
  • TRC duration will vary between 1 and 10 years depending on the investment amount.
  • The DN visa is divide 2 types:
  • DN1: issued to foreigners who work with other enterprises or organizations with legal status as regulations of Vietnamese law.
  • DN2: issued to foreigners entering Vietnam to service offering, the establishment of a commercial presence, and other activities under international treaties to which Vietnam is a party.
  • The working visa (LD) is divided into 2 types, too. For work permit holders and for work permit exemption holders.

3. The changes in visa-exempt nationals:

– Foreigners entering Vietnam under the visa exemption scheme are only required to have a passport which is still valid for at least 6 months. More significantly, the entry requirements are no longer required at least 30 days from the latest exit date. This change nationals of Denmark, Finland, France, Germany, Italy, Japan, Korea, Norway, Russia, Spain, Sweden, and the UK.

4. The change about tourist visa:

– Especially, the law clearly states that foreigners who enter Vietnam with a DL (tourist) visa, if the visa is valid for 1 month, they will be granted a 1-month temporary residence stamp on the visa, if the visa is for a period of 3 months, the temporary residence stamp is only issued for 1 month from the date of entry and want to stay and consider extending the temporary residence as prescribed. So the law is very suitable and limits the subjects who take advantage of tourist visas to work and work illegally in Vietnam.

Point a Clause 1 Article 13 of Law No.51/2019/QH14 provides the following: “The duration of temporary residence is equal to the duration of the visa; in case the visa has a DL category for a period of over 30 days and considered for extension of temporary residence as prescribed in Article 35 of this law.”

 

5. What does THE LABOR CODE change?

– Under the new Labor Code that takes effect in 2021:

Work permit exemptions will be expanded to certain owners and directors and to spouses of Vietnamese citizens

Work permits will be still a limit in the duration of 2 years but are allowed to extend for 2 more years and only once.

Labor contracts: labor contracts for foreign nationals must not exceed the validity period of the work permit. Employees may enter into multiple – term labor contracts with foreign employees provided that the work permit is granted.

Therefore, which one should you choose?


✍️ If you want a longer-term visa or for business purposes or you want to a multiple entry visa, visa on arrival is beneficial for your needs.
✍️ If you do not want to wait at Vietnam airport or arrive by land, e-visa is the best way to obtain your visa to Vietnam.
✍️ If you are an emergency situation, visa on arrival is the way to go as it takes only 2 – 3 working hours to obtain the approval letter for tourism.

PENALTIES FOR OVERDUE VISAS – EXTENDING VIETNAM VISA

– Vietnam visa is a document issued by the Vietnam Immigration Department for foreigners who allowed to stay for a short time in Vietnam for the purpose of Travel – working –  visiting relatives – investing.
– The duration of the visa is 1 month and 3 months. Depending on the purpose of trips, foreigners who choose to apply for a visa have a corresponding period of time.

How long do you expect to stay in Vietnam?

Because when trying Vietnam, if you want to stay for longer than the visa duration is granted, you must extend the current Vietnam visa. And the renewal fee will always be higher than the Vietnam visa application fee on entry

How will the overdue visa be fined?

 What is an overdue visa?

– The visa granted when your entry has expired but you are still staying in Vietnam and have not applied for the extension of your visa. These cases are called “overdue visa” and classified as illegal stay in Vietnam.

Penalties when Vietnam visa expires

  • Foreign nationalities who are living and working in Vietnam, for any reason without timely extending their visas, to overstay visas will be considered as violations of the laws on exit, entry, transit, residence, according to the provisions of Article 17 Decree 167/2013/ND-CP, the time and severity of violations can be summarized as follows:
  1. Caution or a fine of from VND 100,000 to VND 300,000 for foreigners traveling within the territory of Vietnam without carrying a passport or other valuable papers in lieu of a passport.
  2. A fine from VND 500,000 to VND 2,000,000 when the visa expires from 1 day to 15 days or less without the permission of competent agencies.
  3. A fine from VND 3,000,000 to VND 5,000,000 when the visa expires from more than 16 days without the permission of competent agencies.
  4. A fine from VND 5,000,000 to VND 10,000,000 for one of the following actions:

– Using fake passports, valuable papers lieu of fake passports, fake visas, fake temporary residence cards, fake permanent residence cards, fake verification seals for exit, entry, transit or residence.

  1. A fine from VND 15,000,000 to VND 25,000,000 for one of the following actions:

+ Foreigners entry, working and having other activities in Vietnam without permission of Vietnam’s competent agencies.

+ Individuals and organizations in Vietnam guarantee or carry out procedures for foreigners to enter Vietnam, apply for visas, grant Temporary Residence Card, extend temporary residence, valuable papers for entry, residence in Vietnam but not in compliance with the provisions of the law or making false statements when guaranteeing, inviting or carrying out procedures for foreigners on entry, applying for visas, granting temporary residence cards, extending temporary residence, valuable papers for entry, exit, and residence in Vietnam

+ foreigners entry Vietnam for improper purposes, the program which has asked for temporary residence card, permanent residence card.

  1. A fine from VND 30,000,000 to VND 40,000,000 for one of the following actions:

+ Forging documents and papers to be granted passports or other valuable papers in lieu of passports, visas, temporary residence cards, permanent residence cards.

+ Forging a passport or other valuable document in lieu of a passport, visa, temporary residence card, permanent residence card or verification mark.

+ Escaping into embassies, consulates or head offices of international agencies or organizations based in Vietnam

+ Foreigners residing in Vietnam without permission of competent agencies.

+ Organizing, giving or brokering for others to exit or enter Vietnam illegally.

– Foreigners have to commit administrative violations specified in Clause 1, 2, 3, 4, 5 and 6, Article 17 of Decree 167/2013/ND-CP, depending on the seriousness of violations, may be expelled from the Socialist Republic of Vietnam and banning entry with a definite or indefinite term.

What to do when your Vietnam visa expires?

– When the visa expires, foreigners are not allowed to exit Vietnam. Go to the Immigration Department to report and pay a fine. After that, foreigners will be granted a Vietnam visa extension or will be granted permission to leave the country.

– How much the fine depending on the time overdue period or how long foreigners must pay a fine to the Immigration Department. If the situation is too severe, it may be deported immediately and banned from entry into Vietnam.

Extend Temporary Residence For Foreigner Entering Vietnam With 5-Year Visa Exemption

1. What is a 5-year visa exemption?
